These Terms & Conditions (“Terms”) govern your access to and use of the website located at getvolara.com (the “Site”) and the purchase of any products offered by getVolara (“getVolara,” “we,” “us,” or “our”). By accessing the Site, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree, do not use the Site or purchase our products.

1. Research Use Only

All getVolara products are intended for research purposes only and are not intended for human consumption. Our products are not drugs, foods, cosmetics, medical devices, or dietary supplements. They are not intended to diagnose, treat, cure, or prevent any disease or condition, and no such claims are made. By purchasing from getVolara, you represent and warrant that:
  • You are acquiring products solely for legitimate laboratory or research purposes;
  • You will not use, resell, repackage, or distribute any product for human or animal consumption, ingestion, injection, or any in-vivo application;
  • You are a qualified professional or entity capable of handling research materials safely and lawfully;
  • You will comply with all applicable laws, regulations, and institutional policies governing the receipt, handling, storage, and disposal of research chemicals in your jurisdiction.
You assume all responsibility and liability arising from your possession, handling, and use of any product purchased from getVolara.

2. Eligibility

You must be at least 21 years of age (or the age of majority in your jurisdiction, whichever is greater) to use the Site or place an order. By placing an order, you represent that you meet this requirement and that all information you provide is accurate and complete. We reserve the right to refuse service, cancel orders, or restrict access to any person or entity at our sole discretion, including where we reasonably believe a purchase is intended for a prohibited use.

3. Products, Descriptions & Availability

We make reasonable efforts to describe products accurately, including specifications such as purity, quantity, and molecular data. However, we do not warrant that product descriptions, images, or other Site content are complete, current, or error-free. Product colors, packaging, and appearance may vary. All products are subject to availability. We may limit quantities, discontinue products, or modify specifications at any time without notice. Certificates of Analysis, where provided, reflect testing of a representative lot and are provided for informational reference only.

4. Pricing & Payment

All prices are listed in U.S. dollars and are subject to change without notice. We reserve the right to correct pricing errors and to cancel any order placed at an incorrect price, even after an order has been confirmed. Payment must be received in full before an order is processed. By submitting payment information, you represent that you are authorized to use the designated payment method. We use third-party payment processors and do not store full payment card details on our servers. You are responsible for any applicable taxes, duties, or fees imposed by your jurisdiction.

5. Orders & Acceptance

Your submission of an order constitutes an offer to purchase. All orders are subject to acceptance by us. An order confirmation email acknowledges receipt of your order but does not constitute acceptance. We reserve the right to accept, decline, or cancel any order, in whole or in part, at our sole discretion for any reason, including suspected fraud, prohibited use, product unavailability, or pricing errors. If we cancel an order after payment, we will issue a refund for the affected items.

6. Shipping

Shipping terms, processing times, carriers, and delivery estimates are described in our [Shipping Policy], which is incorporated into these Terms by reference. Title and risk of loss pass to you upon our delivery of the products to the carrier. You are responsible for providing an accurate shipping address; we are not liable for orders delayed or lost due to incorrect address information. We do not ship to jurisdictions where the sale, importation, or possession of our products is restricted or prohibited. It is your responsibility to determine whether your jurisdiction permits receipt of the products you order.

7. Returns & Refunds

8. Accounts

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

  • Resell or distribute products in violation of applicable law;

11. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY PRODUCT WILL MEET YOUR REQUIREMENTS. NO ADVICE OR INFORMATION OBTAINED FROM US CREATES ANY WARRANTY NOT EXPRESSLY STATED HEREIN.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GETVOLARA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY PRODUCT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR ANY PRODUCT SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM. Because you acknowledge that products are sold for research use only and not for consumption, you assume all risk associated with any use inconsistent with that purpose.

13. Indemnification

You agree to indemnify, defend, and hold harmless getVolara and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use or misuse of any product; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your violation of any third-party right.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or related to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts.

15. Changes to These Terms

We may modify these Terms at any time. Changes are effective when posted to the Site with an updated “Last updated” date. Your continued use of the Site or placement of orders after changes are posted constitutes acceptance of the revised Terms.

16. Severability & Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. These Terms, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy, constitute the entire agreement between you and getVolara regarding the Site and supersede any prior agreements.
